Alcohol Control PSPO

Monday 5th June 2023-Friday 14th July 2023

Public Space Protection Orders (PSPO’s) are one of a number of new powers introduced by the Anti-Social Behaviour, Crime and Policing Act 2014. They are designed to stop individuals or groups committing anti-social behaviour in a public space which is having or is likely to have a detrimental effect on the quality of life of people in the area. The behaviour must be unreasonable and persistent or continuing in nature.

Since 2017 Flintshire County Council have had in place an alcohol control Public Space Protection Order and are now consulting on extending the current alcohol control Public Space Protection Order.

The prohibitions proposed are:

(a) any person who, without reasonable excuse, continues drinking intoxicating liquor in a public area within the Restricted Area when asked to stop by an authorised officer, commits an offence.

(b) any person who whilst in a public area within the Restricted Area, without reasonable excuse, fails to surrender any intoxicating liquor in their possession when asked to do so by an authorised officer, commits an offence.

(c) an authorised officer who imposes a requirement under Article 4(a) and/or 4(b) above must tell the person that failing, without reasonable excuse, to comply with the prohibition and/or requirement is an offence.

We value your opinion, so please take the time to read the attached literature, which includes a copy of the draft order; a ‘Frequently Asked Questions’ document; and a map of potential sites where the prohibitions would be enforced. Please then complete our online survey on the proposed PSPO conditions.
